Handling of Applications by the Minister to Participate in Section 36(1)(a) Cases by Written Submissions Only

The Canada Border Services Agency (CBSA) Hearings Program is moving towards filing paper-based submissions for the majority of admissibility hearings before the Immigration and Refugee Board of Canada’s (IRB) Immigration Division (ID) for serious criminality convictions in Canada [A36(1)(a)]. This initiative was implemented on April 15, 2013.

The ID has prepared a notice it will send to the parties when it receives an application by the Minister to be allowed to participate in a case by way of written submission only.
