The following summary of referrals of alleged breaches of professional conduct has been published in accordance with the Immigration and Refugee Board of Canada’s (IRB) Policy on Disclosing Information Regarding the Conduct of Authorized Representatives to Regulatory Bodies and associated procedures.
In 2019-20 there were a total of 18 alleged breaches of professional conduct by counsel reported at the IRB: 10 related to lawyers or individuals claiming membership in a provincial bar association, one related to a paralegal subject to regulation by provincial bar association, and 7 related to regulated Canadian immigration consultants.
Of these 18 alleged breaches, 11 were referred to the appropriate regulator: the Immigration Consultants of Canada Regulatory Council or the responsible law society. One of the alleged breaches is currently under the IRB’s review for possible referral in the future. The remaining six alleged breaches were not referred to a regulator. Two of these matters – one in respect of a lawyer and one in respect of a consultant – were addressed by informal discussions.
