Due to the quickly evolving situation associated with the COVID-19 pandemic, the Immigration Appeal Division (IAD) is issuing this Practice Notice regarding the time limits for filing a notice of appeal.
Current Time Limits
The IAD Rules set out various time limits for the filing of a Notice of Appeal.
Temporary Extension
If your time limit for filing a Notice of Appeal falls on or after March 16, 2020, the IAD temporarily extends the time limit for the filing of such Notice until 30 days after the date of the Resumption Notice. The Resumption Notice will be posted on the IRB website. Please check the IRB website regularly.
Monitoring
The IRB is monitoring the situation closely and may make further adjustments as the situation requires. Please check the IRB website regularly for updates.
Authority
Subsection 58(d) of the IAD Rules provides that the IAD may extend the time limit before or after the time limit has passed.
