Building on the recent experience of the Immigration and Refugee Board conducting hearings virtually using Microsoft Teams, the Refugee Appeal Division (RAD) will now schedule virtual hearings for all appeals. This approach, which takes effect November 2, 2020, will ensure continued access to justice while continuing to protect the health and safety of all participants.
When scheduling a hearing, counsel for the appellant will continue to be asked to confirm their availability for the proposed hearing date. They can also request an in-person hearing if they have specific concerns with holding the hearing virtually. The RAD will consider the circumstances of each request on a case-by-case basis.
When the Appellant does not have the technology for Virtual Hearings
The RAD recognizes that not all appellants may have access to the technology required to connect to a virtual hearing, such as a computer, smartphone, or internet access. Additionally, the option to join by teleconference may not always be suitable given the appeal.
In these cases, the RAD will accommodate the appellant, such as having the appellant or all participants attend the hearing in-person. The appellant must advise the RAD at the time of scheduling if they require such accommodation.
