Allegations against Former Counsel - IRB Procedures

The Immigration and Refugee Board of Canada (IRB) has issued a practice notice to outline the steps to be followed when a person who is the subject of an IRB proceeding alleges that they have been inadequately represented by their former counsel.

The practice notice sets out the procedures to follow when an allegation is made before a proceeding is completed as well as when an allegation is made in an application to reopen a case that has been concluded.

These procedures were created to promote fairness, efficiency, and consistency in IRB proceedings. The procedures apply to all refugee claims, refugee appeals, admissibility hearings, detention reviews and immigration appeals.
